A New Mexico Nonprofit in the Gray Area of Political Speech
One organization’s nonpolitical activities is another’s completely political meddling, as a New Mexico nonprofit is discovering. The Center for Civic Policy earlier this year distributed a series of mailers regarding the voting records of some members of the state legislature, a handful of whom, after losing in the primary election, sued the group, saying its efforts crossed the line into political activity. They also want the Center to fully disclose its funders, something that would be required if it were classified as a political action committee and not a nonprofit. Ordinarily this could be dismissed as a he said, she said story, except that the New Mexico attorney general’s office is poking around things. As you might imagine, it’s a tricky situation, with both sides raising valid points. And it cuts to the heart of how much leeway we as a society wish to give like-minded people in terms of what they say … and when. | 501(c)
